Unless otherwise specified, these rules cover routine contests and promotions conducted by Marble City Media LLC (“MCM”) and may be amended for specific contests or promotions.

A contest or promotion (the “Promotion”) will take place during the dates and times specified in the official rules of the Promotion (the “Promotion Period”) or as announced on-air. MCM may change the dates and/or terms of the Promotion without prior notice. Any material changes will be broadcast on-air and posted on this website.

Promotions conducted on-air requiring listeners to take action are only official when heard on-air via terrestrial radio. Due to inherent delays with online streaming, listeners to the online stream may not be able to participate in or be disadvantaged in participating in certain Promotions.

To be eligible to enter or participate in the Promotion, listeners must follow the instructions set forth in the official rules of the Promotion or as announced on-air and must fulfill all of the eligibility requirements of the Promotion. Unless otherwise specified, the Promotion is open to all listeners who are legal residents of the United States and of Alabama. Employees of MCM or affiliated entities, or other radio stations, newspapers, magazines, or online entities, are ineligible to participate or win as are members of their immediate families and/or households. Listeners are eligible to win a prize only once per Promotion.

Entrants are required to provide truthful information, and MCM will reject any entry that it deems false or fraudulent, any entry from individuals who do not meet eligibility requirements, and any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

Promotion prizes and their values will be indicated when MCM announces the Promotion. Unless otherwise announced, all prizes must be claimed at 1 Motes Rd., Sylacauga, AL 35150 between the hours of 9:00 a.m. and 3:00 p.m. weekdays. To claim a prize, promotion winners must present valid government-issued photo identification and provide their complete address, phone number, and date of birth. Unless otherwise permitted by MCM, winners must claim their prize in person. If a Promotion is open to entrants under the age of 18 and a winner is under the age of 18, a parent or legal guardian must claim the prize. Failure to comply with these requirements will result in the forfeiture of the prize. A winner will forfeit any prize or prize certificate not claimed within thirty (30) days (or sooner for time-sensitive prizes). Unless otherwise specified or required by law, if a prize is not claimed, no alternate winner will be selected, and the prize will be forfeited. Each prize is expressly limited to the items announced by MCM and does not include taxes, gratuities, or any other expenses. Other restrictions may apply.

Potential winners will be selected and notified of their prizes in the manner announced by MCM. Promotion winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form or the prize will be forfeited. If a potential winner cannot be contacted, fails to sign and return the required affidavit of eligibility and/or liability/publicity release within the required time period, or if a prize or prize notification is returned as undeliverable, the potential winner forfeits the prize.

Payments of all federal, state, and local taxes related to the award of a prize are solely the responsibility of the winner of the prize. The winner will be required to complete and submit an IRS Form W-9 with the winner’s full Social Security Number for receipt of any prize valued at $500 or more or for any prizes awarded by MCM in a calendar year with an aggregate value of $500 or more, and such winnings will be reported to the IRS. Failure to submit a complete W-9 will result in forfeiture of the prize.

By participating in the Promotion, winners agree to have his or her name, voice, and likeness used in any advertising or broadcasting material related to such Promotion, without further compensation, and to sign a publicity release confirming such consent prior to acceptance of the prize.

MCM is not responsible for telephone or mobile service outages, delays, busy signals, transmission errors, equipment malfunctions, or any other technical difficulties that may prevent an individual from completing his/her entry. If message and data rates apply, MCM is not responsible for any fees incurred by an entrant.

MCM reserves the right to cancel, terminate, or modify the Promotion as it deems necessary if it is not capable of completion as planned, including, without limitation, as a result of infection by computer virus, bugs, tampering, unauthorized intervention, or technical failures of any sort. MCM reserves the right to make changes in the rules of the Promotion, including, without limitation, the substitution of a prize or equivalent value, which will become effective upon announcement. If due to circumstances beyond the control of MCM, any event related to the Promotion or prize is delayed, rescheduled, postponed, cancelled, or has a change of venue, MCM reserves the right, but is not obligated, to cancel or modify the Promotion and shall not be required to award a substitute prize. MCM is not responsible for typographical or other errors in the printing, the offering or the administration of the Promotion, or in the announcement of a prize.

MCM, in its sole discretion, reserves the right to disqualify any person tampering with the entry process or the operation of MCM’s website or social media channels. Failure to comply with the rules of the Promotion may result in a contestant’s disqualification and/or forfeiture of any prize or prizes. If MCM makes a good faith determination that an entrant has committed potentially fraudulent activity in connection with a Promotion, it reserves the right to disqualify that entrant from entering and/or winning future Promotions.

The 98.3 Fox FM “Rocktober” promotion, building on the Sylacauga Rocks fad, will run from Monday, Oct. 9, through Friday, Oct. 27.

Over the three weeks (19 days), a total of 98 rocks with 98.3 Fox FM logos –- at least 30 each week — will be placed in our primary coverage area. None will be “hidden” or left in dangerous or difficult-to-access areas.

The goal of the promotion is not to encourage listeners to search for specific rocks at specific times but rather to find and keep rocks, listen for the number of the rock they’ve found to be announced on the air, and respond via text message.

Each and every rock is numbered and has an assigned and winning value — $25, $50, $100, $250, $500, or $1,000 -– meaning that every rock is a potential winner. A total of $11,625 will be available for award during the promotion period.

Several times each day, we will announce one of the in-place rock numbers and the amount to be awarded to the person who presents that rock. The hopeful winner will have 20 minutes to text the word ROCKS to 59925, then follow validation instructions. We will then make contact by phone to confirm identification (name, address, email address, phone number) and arrange a time for a visit to the station within three business days to certify the rock’s authenticity and exchange it for the designated cash award.

We reserve the right, in our sole discretion, to validate or invalidate the eligibility of any rock presented. No individual or member of a household is eligible to win more than once during the promotion. Employees of and consultants to Marble City Media LLC are not eligible. Winners receiving more than $500 will be required to complete an IRS Form W-9. Untimely responses are ineligible, and unclaimed awards will be forfeited. Winners must agree to use of their names and photos for publicity purposes.
